Terms and Conditions

1. About CarRecovery

CarRecovery is a digital marketplace that connects vehicle owners with independent recovery operators.

We:

  • Do not provide towing or recovery services
  • Do not own tow trucks
  • Do not employ drivers

We act only as a technology, lead-generation, and optional payment facilitation platform.

2. Eligibility

To use CarRecovery you must:

  • Be 18 years old or older
  • Provide accurate information
  • Have legal authority over the vehicle being recovered

3. Platform Role (Important Legal Clause)

When a customer books a recovery service:

  • The agreement is between the customer and the independent driver
  • CarRecovery is not a party to that contract
  • CarRecovery does not guarantee service quality or arrival times
  • CarRecovery is not responsible for any damage, loss, or delays

We are a platform only, not the service provider.

4. Payments (Direct Pay or Pre-Pay)

Customers may choose to:

4.1 Pay the Driver Directly

Payment may be made in:

  • Cash
  • Bank transfer
  • Any method agreed between customer & driver

CarRecovery:

  • Does not handle direct payments
  • Is not responsible for pricing or payment disputes

4.2 Pre-Pay Through CarRecovery

Where available, customers may pre-pay through the platform.

For pre-payment:

  • CarRecovery acts only as a payment facilitator
  • Funds may be held and released to the driver after job completion
  • Service disputes remain between customer and driver, not CarRecovery
  • CarRecovery is not responsible for refunds relating to the service itself.

5. Customer Responsibilities

By using CarRecovery, customers confirm that:

  • All information they provide is accurate
  • They have the legal right to request recovery
  • The vehicle is not stolen
  • They will communicate honestly with drivers
  • They will not engage in fraud, abuse, or misuse of the platform

6. Driver Status

All drivers on CarRecovery are:

  • Independent contractors
  • Not employees, staff, or agents of CarRecovery

Fully responsible for:

  • Insurance
  • Licences and legal compliance
  • Recovery equipment
  • Safety and service quality

CarRecovery does not monitor or guarantee driver qualifications.

7. Limitation of Liability

To the maximum extent permitted by UK law, CarRecovery is not liable for:

  • Vehicle damage
  • Delays or missed recoveries
  • Lost or stolen property
  • Mechanical issues
  • Driver behaviour
  • Pricing disputes
  • Personal injury
  • Failed or incomplete recoveries

All risk lies with the customer and the independent driver.

8. Data Protection

CarRecovery processes and stores personal data including:

  • Names
  • Phone numbers
  • Vehicle details
  • Location information

This is used solely for:

  • Providing the recovery service
  • Communication
  • Fraud prevention
  • Platform operation

We comply with UK GDPR and the Data Protection Act 2018.

9. Account Suspension & Termination

We may suspend or permanently ban users who:

  • Submit false recovery requests
  • Abuse staff or drivers
  • Use the platform illegally
  • Commit fraud
  • Misuse or tamper with the platform

Suspension may occur without prior notice.

10. Service Availability

We do not guarantee:

  • Driver availability
  • Response times
  • That a recovery request will be accepted
  • Uninterrupted access to our platform

11. Amendments

CarRecovery may update these Terms at any time.

Continued use of the platform means the user accepts the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be handled exclusively by the courts of England & Wales.
